Welcome to Pokefolio, operated by Marius Eckerle ("we," "us," or "our"). By accessing or using our mobile application, website, or related services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

Pokefolio is an independent product and is not endorsed by or affiliated with The Pokémon Company International, Nintendo, Game Freak, or Creatures Inc.

2. Description of Services

Pokefolio is designed to help users:

• Track & Value Collections: Manage Pokémon™ Trading Card Game (TCG) cards, sealed products, and accessories.
• Analyze Market Trends: View historical pricing, market caps, and gain/loss charts.
• Sync Across Devices: Securely back up and restore portfolios via our cloud‑sync option.
• Receive AI‑Powered Insights: Generate price explanations, grading suggestions, and natural‑language search results through third‑party AI services.

All additional features or functionalities are governed by these Terms as well as our Privacy Policy.

3. Data Privacy & Processing

Your privacy and data security are fundamental to our operations. To ensure transparency:

1. Supabase Cloud Storage & Authentication
   When you create an account or enable cloud sync, your portfolio data is stored in Supabase's managed EU data centers. Supabase acts as our data processor under the GDPR.
2. AI Processing via OpenAI
   Optional AI features (e.g., price explanations) transmit the minimal required prompts or card metadata to OpenAI's API for real‑time analysis. Full portfolio files are never shared with OpenAI.
3. Local Storage
   A cached copy of your latest portfolio remains on your device for offline access. You may clear this cache at any time from the in‑app settings.
4. RevenueCat Billing Data
   If you subscribe to Pokefolio Pro, RevenueCat processes purchase receipts to validate and manage your subscription.

4. Acceptable Use

To maintain the safety and integrity of our Services, you agree to:

1. Legal Compliance
   Use the Services in accordance with all applicable laws and regulations.
2. Respectful Conduct
   Refrain from harassing, harming, or infringing on the rights of others.
3. System Integrity
   Avoid introducing malware, scraping data, or attempting to bypass security measures.
4. No Unauthorized Access
   Do not attempt to access systems, accounts, or data you are not authorized to use.

Violations may result in suspension or termination of your account or access to the Services.

5. Subscription Terms (Pokefolio Pro)

Pokefolio is offered as a freemium service. Basic features are free; premium features are unlocked through an auto‑renewable subscription ("Pokefolio Pro").

6. Third‑Party Services

Certain features rely on third‑party services. By using these features, you acknowledge and agree to their respective terms of service and privacy policies:

• Supabase – Cloud database, storage, and authentication.
• OpenAI – Natural‑language processing and AI content generation.
• RevenueCat – Subscription billing and receipt validation.

We are not responsible for delays, errors, or misuse of data attributable to these providers.

7. Disclaimer of Warranties

The Services are provided on an "as‑is" and "as‑available" basis, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that:

• The Services will meet your specific requirements;
• The Services will be uninterrupted or error‑free;
• Any information or results obtained through the Services will be accurate, reliable, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law:

• No Indirect Damages
  We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data, even if advised of the possibility.
• Liability Cap
  Our total liability arising out of or relating to the Services is limited to the amount you paid for the Services in the 12‑month period preceding the claim (if any).
• User Actions
  We are not responsible for damages caused by user actions, including misuse of the app or failure to secure your device.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pokefolio, its officers, directors, employees, and affiliates from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising out of:

• Your use of the Services;
• Your violation of these Terms;
• Any data or content you upload, share, or distribute through the Services.

10. Additional Liability Protections

1. Third‑Party Systems
   We are not liable for issues caused by third‑party devices, platforms, or services that interact with our Services.
2. Force Majeure
   We are not responsible for delays or failures due to circumstances beyond our control, such as natural disasters, technical failures, or governmental actions.

11. Modifications to Services & Terms

We may revise these Terms or modify the Services from time to time. Material changes will be communicated in‑app or via email (where available). Updated Terms are effective upon posting; continued use constitutes acceptance.

We may discontinue the Services at any time without liability. Upon termination:

• Your right to use the Services ceases;
• You must delete the application from your devices.
